How much will the divorce proceedings cost?

When it comes to the cost of divorce, there are two main factors to take into account, which are the court fees and legal fees. The court fees are fixed, but legal fees largely depend on the complexity of the case and a lawyer’s charges.

Therefore, it is not easy to determine the cost of divorce but understanding the difference between professional legal fees and court awarded costs (court fees) is important.  Do take note that there are different procedures for Muslim and non-Muslim couples, as Muslim divorce proceedings take place at the Syariah court.

The court cost

You will have to file your divorce application or petition in court first before the divorce process can proceed. This comes with a court fee, which is separate from the legal fees and includes:

  • RM160.00 Filing of a Divorce Petition (General Form of Petition or Joint Petition)
  • RM16.00 Filing of Statement as to Arrangement for Children (General Form of Petition or Joint Petition)
  • RM16.00 Filing of an Affidavit in Support of Petition (General Form of Petition or Joint Petition)
  • RM 6.00 Each exhibit referred to an affidavit, statement or petition and required to be marked

An estimate of legal fees

The more complicated a divorce case is, such as both parties disagreeing on the division of assets, financial support, or when children custody is involved, the more expensive the legal fees will tend to be. A lawyer’s fee can also depend on their seniority and level of experience.

  • Contested divorces: takes a minimum of one year, and may cost a minimum of RM5,000 and can even go up to RM50,000 or more.
  • Mutual Consent Divorces (joint petition): takes three to six months, and may cost between RM3,000 to RM6,000.


Though you may not need to appoint a lawyer when filing for a divorce, this may be the advisable course of action when a Contested Divorce requires a court hearing. This will incur more cost, but at least you have a lawyer to guide you through the tricky process. Bear in mind, however, each time your lawyer attends a court hearing, you will be charged, and this will increase the legal fees.

If the cost of engaging a lawyer worries you, you have the option of legal aid. In Malaysia, there are two main organisations offering legal aid. The first is The Bar Council Legal Aid Center, which was set up by the Malaysian Bar, and the second is The Legal Aid Department, which is under the Prime Minister’s Department.

Before you qualify for legal aid, you will need to undergo a couple of tests. The first test is an online test, known as the “means test” which determines if your financial capabilities fall within the necessary boundary. The second test is known as the “merits test” which basically weighs the merits of your case.

Nevertheless, a Mutual Consent Divorce (joint petition) will always cost less. This means that a couple mutually agrees to divorce; it will be less complex, and the legal fee incurred will be lower. In fact, if you can come to an agreement about financials, matrimonial assets, and the arrangements for children, you may not have to attend a court hearing at all, potentially saving you thousands of ringgits.

What are you entitled to from the divorce?

As for the division of matrimonial assets, that will be decided in Court. The Court can divide assets obtained during marriage by joint efforts of the spouses. In dividing the assets, the Court would consider the followings:

  1. Contribution by either spouse in money, assets or work;
  2. Debts of a spouse for the benefit of both parties; and
  3. Needs of young children.

However, there may be other entitlements like alimony and child maintenance. Alimony is usually awarded to the wife and given by the husband, and this applies to both Muslims and non-Muslims, as well as child custody if the wife has been granted custody.

Under the Islamic law, Muslim women are entitled to:

  • mutaah, a consolatory gift granted by the husband for his ex-wife after their divorce
  • custody of the child
  • maintenance of the child
  • maintenance period of iddah (the period a woman must observe after the death of her spouse or after a divorce)
  • harta sepencarian (property jointly acquired by husband and wife during the subsistence of the marriage in accordance with the conditions stipulated by Hukum Syarak.)


Divorce cases may open a can of worms as both sides battle it out during the court proceedings, and it can also stretch on for years. As a result, the consequences of divorce is beyond the battles of assets but can also affect one’s psychology and morale, as well as the children involved. During or after the divorce procedure, some individuals may seek counselling and therapy which can cost between RM300 – RM400 per session (or more) at private psychologists.

Also consider the fact that you no longer have shared income, which means you will be shouldering your expenses separately from now on. Do review your monthly budget and spending to help you ease into adjusting to a single income.

Selain itu, untuk hutang kad kredit, anda boleh gunakan pelan pindahan baki, kerana pelan ini menawarkan kadar yang lebih rendah. Tetapi, pastikan anda mampu membuat bayaran kerana tempoh bayaran balik pelan ini ialah lebih pendek.

3. Yuran kad kredit

How much can you save if your car lasts longer?

While we haven’t heard of Malaysian car owners who have driven over 500,000km, let alone 999,999km, imagine how much you can save by owning just one car for that many years.

In an article by car content platform WapCar, it was revealed that on average, Malaysian drivers cover 28,188 km a year. That means you’ll need about 18 years to pass that 500,000km mark.

As a new car is typically kept for an average of 8.4 years (according to research firm iSeeCars.com), most Malaysians would have switched cars thrice during this 18-year period.

Considering that the most affordable car now is the Perodua Axia E 1.0 manual at RM23,367, you’d probably have to buy a new Axia model thrice if you switch cars every 8.4 years. Thus you may have to spend at least RM70,101 during this period, and we haven’t factored in inflation, as well as your car loan interest and insurance fees.

Buying a car in Malaysia is a relatively easy affair, especially when it comes to the more affordable cars such as the Perodua Axia or Proton Saga. With low (or even zero) down payments and long car loan tenures, purchasing a car is accessible to most. Despite this, maintaining that purchase is another story altogether.

A car loan is the first of the top four causes of bankruptcy in Malaysia, as reported by the Insolvency Department of Malaysia. That usually happens when a person realises that they cannot continue paying a car loan, thereby defaulting it. While it is easy to get started on purchasing a car, you’ll need to be rather disciplined to continue paying for it monthly.

So, what happens when you find yourself being unable to pay a car loan? You run the risk of having your car repossessed by the bank that provided you with the loan.

It doesn’t necessarily have to happen instantaneously after you missed one payment, however. It could be after the second or even third missed payment – different banks have different repossession terms, so it is best you clarify with your bank.

With that said, there are several different stages that are taken by the banks when they act to repossess your car.

The car repossession process:

car-repossession-process As part of the car repossession process, the bank will have to send the car owner a few notices as a reminder.

1. Pre-repossession notice(s)

If you’ve missed your car loan payment for two consecutive months, your bank will send you and your guarantor a pre-possession notice, also known as a Fourth Schedule notice.

The notice is intended to inform you that the bank is planning to repossess the car. You have 21 days after to sort out the matter to avoid repossession.

After 14 days, the bank will send another notice as a reminder.

2. The repossession

After that 21 days from the Fourth Schedule notice, the bank will have the right to repossess the car if any outstanding dues aren’t paid.

3. Post-repossession notice

After repossessing your car, the bank will send you a notice to inform you that it has successfully repossessed the car. After another 21 days upon receiving this notice, you will receive another notice, the Fifth Schedule, which will include the amount you have due to pay the bank.

The Fifth Schedule notice will indicate the amount you have due to pay the bank. This will typically include the missed payments and may include additional fees and charges from the bank.

4. Disposal of the vehicle notice

After 21 days of the Fifth Schedule, if you haven’t paid the dues, then the bank will send you another notice stating that it will be disposing of the vehicle. 

The disposal process may either be sold through a public auction or a private sale.

5. Selling the vehicle

The vehicle will be sold by the bank 14 days after they served you the disposal notice. 

Typically, the auctioned price will be at a value that is lower than the current market value. The proceeds from the sale of the vehicle will be used to pay any dues to the bank; if the amount doesn’t cover the dues, then you will be required to pay the rest.

Having your car repossessed is not a debacle that anyone would want to go through with. It isn’t an easy process to handle either, though most banks have a Code of Ethics on Repossession that makes the process as smooth and friendly as possible. 

Regardless, if the unfortunate repossession of a car does happen to you, perhaps it is a sign that you may not be able to afford a car.

If your car does end up being repossessed, it’s important that you know your rights and the rules of repossession in Malaysia.

The following points are part of Public Bank’s Code of Ethics but edited for clarity. Remember, that different banks will have different Codes of Ethics, so ensure that you check with your bank before the repossession process starts. 

  1. Permit holders must ensure that they possess a current and valid permit during the course of carrying out the repossession work.
  2. The number of authorised permit holders performing repossession activities must be minimised unless circumstances warrant any additional assistance.
  3. Repossession work can only be carried out daily from 9 a.m. to 9 p.m.
  4. Permit holders issued with a repossession order by the owner should only gain entry into premises with the knowledge and consent of the occupant. Trespassing into private property is not allowed without a court order obtained by the owner.
  5. Permit holders issued with a repossession order by the owner should be well mannered and dressed decently. They should ensure the practice of professionalism and dignity in carrying out their work.
  6. The use of “strong-arm tactics” of any kind is strictly prohibited in the performance of their work.
  7. At the time of repossession, the permit holders should:
    • Produce his permit, national registration card and give a standard notice to the hirer informing him of the address and telephone number of the legal owner and the authorised officers he/she can contact immediately to resolve any problem.
    • Give a reasonable time to the hirer to inspect the motor vehicle or goods and remove his personal items and belongings.
    • Take photographs of the interior and exterior of the motor vehicle or goods and provide such photographs to the legal owner.
    • Cause to be issued an inventory list to state the status and the condition of the repossessed motor vehicle or goods.
  8. As far as possible, repossession should be undertaken in the presence of the hirer or any person authorised to use that motor vehicle or goods.
  9. A police report on the repossession should be lodged as soon as practicable and preferably within 24 hours—but in exceptional circumstances, not later than 48 hours from the time of repossession.
  10. Permit holders issued with a repossession order by the owner should at all times act in accordance with the laws, regulations, terms and conditions, code of ethics and guidelines issued by the Controller in the performance of their repossession activities.
  11. Permit holders should also observe any other Code of Ethics or Guidelines issued from time to time by the Controller.

Getting your car repossessed is a terrible situation to be in, but don’t let it discourage you. If anything, it’s a great opportunity to learn what NOT to do to avoid the possibility of this unfortunate event from repeating itself in the future.

How you can avoid your car from repossession

  • Since the core of your problem is your financial difficulty, the next logical step is to discuss this matter with your bank. Find out if there’s a way for you to restructure your car loan.
  • If you come to terms with your bank, they may revise your monthly payments and/or extend the tenure to help ease your burden. However, banks are in no obligation to revise your finances. So don’t expect them to help you if they are not willing to.
  • If the bank refuses to revise your monthly payments, and you are not able to pay off what is due, your next best option is to sell your car before it enters the repossession stage. But the process of selling your car is not something that can be done overnight or even in a day, so ensure you have enough time to dispose of your vehicle and settle your loan with the bank.
  • If none of these steps sounds doable to you, then the best way to avoid being in such a situation is to pay your loan on time.
